The Criminal Court has suspended Judge Hussain Faiz Rashad for 60 days, the maximum duration allowed for a judicial suspension, following controversial decisions in high-profile cases currently under investigation by the Judicial Service Commission (JSC).
Sources indicate that Judge Faiz’s suspension stems from his decision to release Ali Anwar Mohamed from remand. Ali Anwar, widely regarded as a prominent drug lord, faced allegations of smuggling large quantities of narcotics into the Maldives. Last week, he had been held in remand for five days, but was unexpectedly released when his remand period expired during a court hearing on Saturday, with no reasons provided for the early release.
Ali Anwar has faced multiple serious charges, including the alleged smuggling of 70 kilograms of drugs into the Maldives via an Iranian vessel. Although authorities had issued a separate order for his arrest following his release, he had already left for Sri Lanka. Cooperation with Sri Lankan authorities eventually led to his deportation back to the Maldives, where he was promptly arrested.
Anwar was initially detained in October 2019 during a joint operation between the Maldivian and Sri Lankan coast guards and police. During the operation, authorities confiscated 70 kilograms of drugs from two vessels: an Iranian ship and a Maldivian fishing boat, the Hedheykuri-7. Anwar, who has a prior theft conviction, is believed to have been one of three men involved in the smuggling operation.
Judge Faiz’s suspension also relates to his handling of the Haleemath Lamha murder case. Lamha, accused of killing IGMH nurse Mary Grace in 2021, had been granted bail twice by Faiz. Both rulings were later annulled by the High Court, and she was briefly released earlier this month. The prosecution raised concerns again, prompting the High Court to demand action on her remand status.
Faiz has stated that a ruling on Lamha’s remand could only be made after an assessment of her potential threat to the community. He claimed to have requested the prosecution to carry out this evaluation, which had not yet been completed.
This is not the first suspension for Judge Faiz. In 2021, he was suspended in connection with the 2019 ruling that sentenced former President Abdullah Yameen to prison. The suspension followed leaked audio tapes allegedly involving Faiz discussing the case with another judge. However, a later investigation dismissed the tapes as invalid, and Faiz, along with judges Ali Adam and Mohamed Sameer, had their suspensions revoked.
The current 60-day suspension underscores the ongoing scrutiny of judicial decisions in cases with significant public and legal interest in the Maldives.
