The Criminal Court has approved a request from the Prosecutor General’s (PG) Office to amend an embezzlement charge against former Football Association of Maldives (FAM) President, Bassam Adeel Jaleel. The change increases the potential penalty he faces if convicted.
Bassam is accused of money laundering and embezzlement for allegedly misusing USD 1.2 million of FIFA funds intended for FAM to purchase a luxury apartment in the Amin Avenue project developed by Amin Construction.
Initially, the State charged Bassam under Section 210(b)(2) of the Penal Code, which classifies embezzlement as a fourth-degree felony. Under this provision, the basic jail sentence is one year, seven months, and six days if the embezzled property exceeds MVR 50,000, or if it involves a motor vehicle, boat, weapon, or other motorized asset.
However, during the Criminal Court hearing on Friday, the PG’s Office stated that the embezzled funds exceed MVR 500,000. As a result, the prosecution requested that the charge be amended to Section 210(b)(1), which defines embezzlement of property exceeding MVR 500,000 as a third-degree felony. This carries a basic prison sentence of three years, two months, and 12 days.
State Attorney Ahmed Shafeeu explained that under the Criminal Procedure Act, the court has the authority to allow such amendments. He attributed the initial misclassification to a “human error” and emphasized the need to correct the charge.
Bassam’s legal team opposed the amendment, arguing that the request should have been made earlier in the case, before the preliminary stage. They contended that it is unfair for such a significant error to remain in a case prepared by the State, which employs hundreds of lawyers, against an individual citizen.
Despite these objections, the presiding judge approved the amendment under Section 91 of the Criminal Procedure Act, officially upgrading the embezzlement charge to a third-degree felony.
Bassam is already serving a four-year sentence for a separate embezzlement conviction. If the amended charge is proven, the penalty could escalate, with the maximum sentence for a third-degree felony reaching eight years in prison.
In addition to embezzlement, Bassam faces a money laundering charge, which carries fines ranging from MVR 100,000 to MVR 1 million and imprisonment between five and 15 years.
Both charges stem from Bassam’s agreement to purchase an eight-room, 10-bathroom apartment on the 12th and 13th floors of Block A of Amin Avenue. The total price, including GST, was MVR 25 million. The State alleges that he used FAM’s dollar account to transfer the payment to various companies, ultimately disbursing the funds to Amin Construction.
Furthermore, the State has requested that Bassam pay USD 1.2 million as compensation for FAM’s losses and that the penthouse be seized by the government.

ދައުލަތާއި ދިފާޢީ ވަކީލުގެ ވާހަކަތައް:
ދައުލަތުގެ ވަކީލު އަޙްމަދު ޝަފީޢު ވިދާޅުވީ، ދައުވާ ހުށަހެޅުމުގައި "އިންސާނީ ގޯހެއް" ދިމާވެގެން ގޯސް މާއްދާއެއް ހިމެނުނީ ކަމަށާއި، މި ގޯސް އިސްލާހުކުރުމުގެ ފުރުޞަތު ޖިނާޢީ އިޖުރާތުގެ ޤާނޫނުގެ ދަށުން ދޭން ޖެހޭނެ ކަމަށެވެ.

ދެ ފަރާތުގެ ބަހައްޓައްފަހު، މައްސަލަ ބައްލަވާ ޤާޟީ ވަނީ ޖިނާޢީ އިޖުރާތުގެ ޤާނޫނުގެ 91 ވަނަ މާއްދާގައިވާ ގޮތުގެ މަތިން، ދައުލަތަށް ދައުވާއަށް އިސްލާހު ގެނައުމުގެ ހުއްދަ ދެއްވާފައެވެ. އެހެންކަމުން، ބައްސާމްގެ މައްޗަށް އުފުލި މަގާމުގެ ނުފޫޒު ބޭނުންކޮށްގެން ފައިސާގެ ނާޖާއިޒު ފައިދާ ނެގުމުގެ ދައުވާއަކީ މިހާރު 3 ވަނަ ދަރަޖައިގެ ޖިނާޢީ ކުށެކެވެ.
ބައްސާމް މިހާރު ވެސް އަންނަނީ ޖަލު ޙުކުމެއް ތަންފީޒުކުރަމުންނެވެ. އެހެންކަމުން، މިހާރުގެ ދައުވާއަށް އިތުރަށް އަދަބު ބޮޑުވެ، އެންމެ ބޮޑުވެގެން އަށް އަހަރުގެ ޖަލު ޙުކުމެއް އައުމަކީ އެކަށީގެންވާ ކަމެކެވެ.
