The High Court has dismissed the appeal in the high-profile 72kg drug smuggling case involving Irfan Thagiyyu after the Prosecutor General’s office failed to pay the required registration fee.
The appeal was originally filed against a Criminal Court ruling that acquitted Thagiyyu, citing insufficient evidence to prove his involvement in the crime.
Thagiyyu, a resident of Dheyliaage, S. Hulhudhoo, was accused of leading a group attempting to smuggle 72 kilograms of diamorphine aboard the vessel Masjaree-2 in December 2020.
Two other individuals were charged alongside him: Mohamed Akram from H. Garden Beauty and Ahmed Naseer from Ambugasdhoshuge, Dh. Maaenbudhu. The cases involving Akram and Naseer are also under appeal at the High Court.
Assistant Registrar of the High Court, Mariyam Hurusheedha, confirmed that the appeal could not proceed due to the non-payment of the registration fee. She explained that the High Court had emailed the Prosecutor General’s office earlier this month requesting payment.
“Since the fee was not paid within the allotted timeframe, the case cannot be accepted under Article 33(c) of the Judicature Act,” Hurusheedha stated.
The Prosecutor General’s office responded, saying they had not received the High Court’s email notifications. They indicated that no emails were received on the initial day or the following day when the fee reminder was sent.
“We will be reviewing this decision. We believe the High Court should also reconsider this matter,” the office said in an official statement.
In January, the Criminal Court acquitted Thagiyyu, Akram, and Naseer, ruling that the state failed to prove beyond a reasonable doubt that the drugs were aboard the vessel.
The state also withdrew charges against seven additional suspects, citing insufficient evidence in line with superior court rulings.

ހައިކޯޓުގެ އެސިސްޓެންޓް ރަޖިސްޓްރާރު މަރިޔަމް ޙުރުޝީދާ ނިންމަވާފައިވަނީ، ކްރިމިނަލް ކޯޓުގެ ޙުކުމް އިސްތިއުނާފު ކުރުމަށް ޕްރޮސެކިއުޓަރ ޖެނެރަލް (ޕީޖީ) އޮފީހުން ހުށަހެޅި މައްސަލަ ބަލައި ނުގަންނާނެ ކަމަށެވެ. އެގޮތުން، މައްސަލަ ރަޖިސްޓްރީ ކުރުމުގެ ފީ ދެއްކުމަށް އެދި މިމަހު ޕީޖީ އޮފީހަށް އީމެއިލް ފޮނުއްވާފައިވާނެ ކަމަށް އޭނާ ވިދާޅުވިއެވެ.
ނަމަވެސް، ކަނޑައެޅިފައިވާ މުއްދަތުގެ ތެރޭގައި ފީ ނުދެއްކުމުގެ ސަބަބުން، ޤާނޫނު ނަންބަރު 2010/22 (ޖުޑިކޭޗަރ އެކްޓް) ގެ 33 ވަނަ މާއްދާގެ (ނ) ގެ ދަށުން މައްސަލަ ބަލައި ނުގަތުމަށް ރަޖިސްޓްރާރު ނިންމެވިއެވެ.
ޕީޖީ އޮފީހުން ބުނެފައިވަނީ ހައިކޯޓުގެ އެފަދަ އެއްވެސް އީމެއިލެއް އެ އޮފީހަށް ލިބިފައިނުވާ ކަމަށެވެ.
އީމެއިލް ފޮނުވިކަމަށް ހައިކޯޓުން ބުނި ދުވަހުއާއި އޭގެ ފަހު ދުވަހުވެސް މަސްތުވާތަކެތީގެ މި މައްސަލައާ ގުޅޭ އެއްވެސް އީމެއިލެއް ލިބިފައި ނުވާ ކަމަށް ޕީޖީ އޮފީހުން ބުނެއެވެ.
"އަޅުގަނޑުމެން މި ނިންމުން މުރާޖަޢާ ކުރާނަން. މި ނިންމުން ހައިކޯޓުންވެސް މުރާޖަޢާ ކުރަންޖެހޭ ކަމަށް އަޅުގަނޑުމެން ދެކެން،" ޕީޖީ އޮފީހުގެ ބަޔާނުގައި ވެއެވެ.
މި އަހަރުގެ ޖަނަވަރީ މަހު، ކްރިމިނަލް ކޯޓުން ވަނީ މި ތިންމީހުންވެސް ބަރީޢަކޮށްފައެވެ. އެއީ، ނާލުގައި މަސްތުވާތަކެތި އެތެރެކުރިކަން އެއްވެސް ޝައްކެއްނެތި ސާބިތު ނުވާކަމަށް ނިންމައިފައެވެ.
މީގެ އިތުރުން މި މައްސަލައިގައި ތުހުމަތުކުރެވުނު އިތުރު ހަތް މީހެއްގެ މައްޗަށް ދައުލަތުން އުފުލި ދަޢުވާތައް ވަނީ އަނބުރާ ގެންގޮސްފައެވެ. އެކަމަށް ޕީޖީ އޮފީހުން ބުނެފައިވަނީ، މަތީ ކޯޓުތަކުގެ ޙުކުމްތަކަށް ބަލާއިރު އެ ހަތް މީހުން ކުށްވެރިކުރެވޭނެ ފަދަ ހެކި ނެތުމުން ކަމަށެވެ.
